By downloading, installing, or using PhotonBlaster (“Software”), you agree to these Terms of Use. If you do not agree, do not use the Software.
2. License
Licenses are sold one‑time per tier (Starter, Professional, Enterprise). Licenses are non‑transferable and grant you the right to run the Software for your organization.
3. Bring Your Own SMTP
You are responsible for complying with your SMTP provider’s acceptable use policies and for all content sent via the Software.
4. Acceptable Use
- No illegal content or harassment.
- Honor unsubscribe and opt‑out regulations in your jurisdiction.
- Maintain accurate sender identities and headers.
5. Data & Privacy
Recipient lists remain your property. The Software provides unsubscribe, bounce handling, and export tools to help you manage data responsibly.
6. Updates & Support
Where applicable, updates and support terms are defined by your license tier. Critical security patches may be issued at our discretion.
7. Warranty & Liability
Provided “as‑is” without warranties. We are not liable for indirect or consequential damages including lost profits or deliverability impacts.
8. Termination
We may suspend licenses for violations. You may terminate by ceasing use. Sections on liability and acceptable use survive termination.

10. Privacy
We respect privacy. Recipient data stays under your control. We provide tools to export, delete, or anonymize data on request. Follow local laws when collecting and processing personal data.
11. Data Retention
You control retention. We recommend a retention policy that removes inactive recipients after a period (e.g., 24 months) and purges hard bounces automatically.
12. Refunds & Returns
One‑time licenses are non‑refundable except as required by law. Support tiers may include limited refund windows described in purchase terms.
13. Governing Law
These terms are governed by the laws of the vendor's primary jurisdiction. Disputes may be resolved in local courts unless alternate arbitration is agreed.
